("organization") Terms of Service and Acceptable Use Policy 1) Your use of the service a) You may only use the services provided by this organization if you agree to be in compliance with the articles of incorporation, bylaws, terms of service, and acceptable use policy of this organization. Changes will be communicated with at least 14 days notice, and your continued use after that time is considered acceptance. b) You may not use any of the services if you intend use even one service to inflict harm or damage upon someone else or someone else's property. c) The organization ("it" or "we") acts as an intermediary between you and those with whom you wish to communicate. It does not, as a matter of course, review, edit, modify, censor, or intercept any of those communications. However, it MAY view any communication or data passing through its system for the sole purpose of diagnosing technical problems or preventing abuse. Safeguards exist to prevent access to your data by anyone other than the administrators of the system; if those safeguards are violated, your data may be at risk, so you are advised to take precautions with your passwords and anything you wish to be absolutely certain remains secret. 2) Eligibility to use the service a) Only members or associate users, defined by the bylaws, may use any of the services of the organization. b) Any member or associate user making use of the services of the organization for use unrelated to the organization--such as sending or receiving a personal e-mail or hosting a website--is deemed to be doing so as an individual and not as an agent or officer of the organization. This applies even if the member is otherwise an officer, director, agent, or employee of the organization. c) All members are equal in respect to availability of the services of the organization, and take priority over the availability of services to an associate user. There may be technical requirements to use a service--such as knowledge of a specific program or the member owning specific hardware--that apply prior to being granted access, but no distinction will be made between members who otherwise meet the requirements. 3) The organization's responsibility to you a) We will provide communications services to you on a space-available basis, provided you have met the requirements to use a requested service. We cannot guarantee uptime or perpetual availability. b) Due to technical and budget constraints, we do not back up any user data. We do strive for fault tolerance of your data so that it is unlikely to be lost as a result of a hardware or software failure owned by the organization, but user data is not saved separately. Please, back up your data. c) We may be required to turn over data regarding you to a law enforcement or government agency, or in response to a civil complaint. If we are not prohibited from doing so, we will notify you if this happens and provide copies of any documents we can release that are related to this request. In addition, we will--subject to budget, resource, or other constraints--attempt to resist the disclosure of any information demanded of us, but cannot guarantee that we will be successful or even have the funds, access to experts, or any other thing or person needed to try or be successful.
